What is the Thai Law on Permanent Residency?

The Thai Law on Permanent Residency is embodied in Chapter 5, Entering to take up residence in the Kingdom, of the Immigration Act, B.E. 2522 of 1979.

The Immigration Committee, a pivotal authority in immigration matters, is entrusted with handling immigration and residency matters as embodied under Thai law, including Permanent Residency (PR) in the country as relevant to this Article. This committee is responsible for allowing foreigners to take up residence, setting criteria regarding the qualification of aliens, such as conditions regarding national security and other conditions, applying for the residence of aliens, permitting foreigners to take up residence in the Kingdom, establishing regulations regarding the financial status of such foreigners, and ordering to suspend permission to reside in the Kingdom.

All of these laws are stated in the Immigration Act BE 2522 of 1979 under Chapter 5, specifically sections 40 – 53.

What are the Conditions for Applying for Permanent Residence Status in Thailand?

Understanding the conditions for applying for permanent residence status in Thailand, including the categories, qualifications, and annual quota, is crucial to navigating the application process effectively.

As to categories, each individual can choose what category applies and is most relevant for them to get permanent residency status. It may be investment, business, work, humanity or other reasons.

As to qualifications, once you relate and fit perfectly into one of the categories and have the essential qualifications needed for permanent residency, you can start processing your status. The qualifications needed are the standards required by law, which will be further discussed in the following paragraphs of this article.

As for the annual quota, it is essential to note that while everyone is eligible to apply, there is a limit to the number of individuals who can be granted this privilege in a year. This is necessary to ensure a balanced and fair distribution of permanent residency status. The number is limited to not more than one hundred people per country per year. The limit is even lower for stateless persons, with not more than fifty persons per year.

1. Investment Visa category

For the investment visa in Thailand, the applicant must invest at least 10 million Baht in the Kingdom and be certified with a letter from the commercial bank in Thailand revealing proof of financial remittance. The applicant’s investment must be of interest to the national economy.

Foreign nationals granted a residential permit must present documentary evidence of their investment acquisition to the Immigration Commission or an authorized official by the end of September of each year, and this submission must be made for 3 consecutive years from the day the residential permit was granted.

2. Business Category

The applicant for the business category must demonstrate strong financial stability. This includes being in a position of executive officer, such as President of a Committee or Committee of juristic persons, with at least 10 million Baht in capital registered in Thailand. The applicant must have been authorized as a signatory for such a juristic person for at least one year until the submission date.

The applicant must have a consistent income of at least 50,000 Baht per month, up to the date of application submission, for two consecutive years, and a tax return is required. The business in which the applicant works must be of interest to the national economy.

3. Work Permit Category

For the applicant who qualifies for the work permit category, the applicant must hold a work permit for at least three consecutive years until the submission date and must have been working in the current company stated in the application for at least one year up to the date of application submission.

The applicant must earn at least 80,000 Baht per month for at least two years until the submission date, or the applicant must have been paying personal income tax of 100,000 Baht for at least two consecutive years up to the date of the application submission.

4. Humanity and Other Reasons Category

Under this humanity category, you can find the specific criteria that apply to your situation. This category is for those with a close familial relationship with a Thai citizen, such as a parent, child, or spouse.

Several scenarios can fall under the humanity category. For instance, you may be eligible if you provide patronage or you are under the patronage of a Thai national spouse, a child who provides patronage or is under the patronage of a Thai national father or mother, or a foreign national father or mother who wishes to give patronage or be under the patronage of a Thai national child.

For this category, you must meet specific requirements. These include the filiation requirement, proof of marriage for spouses, a sufficient annual income, evidence relevant to the patronage requirement, and necessary documents to support this category.

In the expert category, the applicant must have graduated with at least a Bachelor’s Degree and possess a special ability that is needed and beneficial to this country. The applicant must also be supported and officially certified by the authority concerned and have a letter pertaining to the applicant’s service in such a position indicating that, up to the date of application submission, a period of at least three consecutive years in the service is required.

As to the case basis category, the qualification for an applicant must be an individual who produces a benefit to the Kingdom of Thailand or the Thai Government or was selected by a national institute as the one whose performance causes benefit to this country or performs for the authority and Certified in the form of letter. The Immigration Committee will consider other qualifications or the number of residential permits to be granted as it deems appropriate.

Possess the Required Qualifications for PR status in Thailand

The following main qualifications must be possessed for an applicant to be assessed for permanent residency status in Thailand:

  1. The applicant must hold a passport that bears a Non-Immigrant Visa and was granted one-year visa extensions, which reveal that the applicant has been staying in the Kingdom for at least three consecutive years until the day of the submission;
  2. The applicant, who must be at least 14 years old, should have a clean record verified through fingerprint and identity records;
  3. The applicant must reveal information on their income, assets, professional knowledge, vocational proficiency, and family status in connection with Thai national conditions on national security or others as deemed appropriate for the consideration;
  4. The applicant must be able to understand and speak the Thai language;
  5. The applicants fit one of the following categories: Investment, Working/Business, Humanity Reasons, Expert, and Extra circumstances on a case-by-case basis category.

Follow the Annual Quota Announcement for Permanent Residency Status in Thailand

As stipulated in Section 40 of the Immigration Act, the Minister, with the consent of the Cabinet, has the authority to publish an announcement in the Royal Gazette specifying the number of foreigners who will be granted annual residence in the Kingdom. Seven days or a week after the receipt of the residence certificate, the resident must then apply for an alien book (red book) at the local police stations, which is the equivalent of the Thai national ID Card, and the red book must be renewed every year at your local police station.
